Changes to the UK settlement system could impact migrants already in the country and protections aren’t guaranteed yet.

What do the proposed “Fairer Pathway to Settlement” changes really mean?

There has been growing concern among employers and migrants about whether the Home Office's proposed Fairer Pathway to Settlement model could affect individuals already in the UK with leave as a Skilled Worker.

This issue was raised directly in Parliament. On 20 January 2026, Catherine West MP asked the Home Office whether migrants already in the UK might be protected by transitional arrangements if the settlement framework changes.

Responding on behalf of the Home Office, Mike Tapp (Labour MP), confirmed that the transitional arrangements referenced in current guidance relate only to operational and system changes as the Home Office moves between frameworks.

Crucially, they do not set out protections for migrants already in the UK to remain on their existing route to settlement, a factor which is being reviewed in the final stages of consultation.

MPs have suggested that transitional arrangements may not apply.

  • Current Skilled Workers may not automatically retain their existing settlement pathway.
  • Sponsoring employers should prepare for potential immigration framework changes from April 2026.
  • Forward planning is becoming increasingly important for both migrants and businesses.
