From 1 January 2021, businesses wishing to hire an EU or non-EU worker in the United Kingdom are required to hold a Sponsor Licence from the Home Office’s UK Visas & Immigration Section (UKV&I).

A Sponsor Licence is essentially a contract between your company and the government that aims to guarantee that you will comply with the duties associated with sponsoring migrant workers.

The Sponsor Licence application process can be challenging, with routine audits of your human resource systems being carried out by officers from the UKV&I. If employing migrant works is critical to your business, it is essential that your business remains compliant at all times.

Employers who hold a Sponsorship Licence and are seeking to employ foreign nationals are required to issue potential employees with a Certificate of Sponsorship.

To issue a Certificate of Sponsorship the employer must be able to show that:

  • The position is a genuine vacancy with remuneration equal to that which a UK national would receive were they to be employed in the same position.
  • The role must also be at or above the National Vocation Qualification (NVQ) level 4.
